Terms and Conditions of Sale

These terms and conditions apply to each auction sale (“Sale”) conducted by or in conjunction with Nunneley Estates & Appraisals (herein Nunneley, we, us). By registering to participate in a Sale, you expressly agree to these Terms and Conditions of Sale.


Before you can bid, you must register to bid online and provide your credit card information. Contact us for approval without credit card. Once you have registered you will be liable for any and all bids made through your bidding account (“Account”), so please keep your credentials confidential.

You will need to register for each Sale that you wish to bid on. This can be done at: bid.nunneleyestates.com.

Bidding Process

Once you have successfully registered to bid in a Sale, you can bid for a Lot by clicking the “Bid” button. All bids are Per Lot, with a corresponding Lot number in the catalog. Each bid shall be binding as soon as you submit your bid.

The current bid will be displayed during the Sale. If you have the leading bid, it will be indicated on the screen. In the event of a tie between a bid placed by you online and any other identical bid(s) (including telephone bids and other online bids through other Online Auction Platforms), it will be at our discretion as to which bid shall be accepted. 

Close of Bidding on Lots

At the scheduled closing date of a Sale, Lots will begin to close at a set number of Lots per minute at the listed time. Each Lot may be subject to a “soft close”, where a bid placed near the close of a Lot will extend the bidding time until the time expires or there is no more bidding activity.

Hammer Price, Buyer’s Premium and Purchase Price

The “hammer price” is the price a Lot has successfully closed at to the winning bidder. The winning bidder is the Buyer of the Lot.

The “Buyer’s premium” is the percentage payable by the Buyer and retained by us. THE Buyer’S PREMIUM IS EQUAL TO 25% OF THE HAMMER PRICE.

The final purchase price of any Lot won by you shall equal the total of a) the hammer price,  b) the Buyer’s premium and c) any applicable California sales tax.
If you are except from sales tax, you must submit a copy of your sellers permit prior to paying for your Lot(s), and your final purchase price will equal the hammer price plus the Buyer’s premium. 

You agree to pay for and arrange for fulfillment of any Lot that is the subject of a successful bid submitted by you or from your Account, in accordance with the following Sale Conditions:

Payment - Invoice for all Lots successfully won by you will be sent to the email address on file. Invoice(s) must be paid for, in full, within 3 days following the Sale. Preferred method of payment is by the credit card placed on file during your bidder registration. Alternate forms of payment must be approved by us prior to bidding.

Pickup Option - Sales may have a designated pickup time and location. You or a courier/individual designated by buyer can pick up your item at the designated time and location. You must provide your own tools, labor and transportation. Purchases will be released upon presentation of proof of payment as well as proof of identification. We will not be liable for any damages incurred by you upon the pickup or transport of your item(s). 

Packing and Shipping - We will deliver Lots to third party shipping companies for professional packaging and delivery. We prefer UPS, FedEx, and Capitol Crating in Sacramento, CA for larger items. Buyers are solely responsible for all shipping costs and are encouraged to request a shipping quote prior to bidding. The final shipping cost is subject to added insurance based on the final purchase price. It is your responsibility to understand the potential delivery costs before agreeing to purchase a Lot. Nunneley Estates & Appraisals will use reasonable efforts to make Lots available to ship within five (5) business days after the Buyer’s invoice is paid.  

Handling Fee - Items which must be moved from one location to another in order to make alternate pickup arrangements or for delivery to a shipping carrier are subject to a handling fee of $10 per lot.

Failure to Pickup – In the event that Buyer fails to pickup or designate shipping for Lots won, Buyer agrees that title to abandoned items with automatically transfer to Nunneley Estates & Appraisals. 

Lots Sold Without Warranty and Without Returns

Condition reports are available during any Sale, and we will make ourselves available to attempt to answer questions you may have about a Lot. Condition reports are based on visual inspection only, unless a lab report is explicitly provided. All property is sold “AS IS” without any warranties. Bidding is entirely at your own risk based on your review of the information provided for each Lot. Nunneley Estates & Appraisals may accept returns in cases of material errors in the item description made by us and it is at our sole discretion whether we accept or reject a return under this policy.


Please note that the Sale is conducted, and all bids are made in United States Dollars ($ USD), and it is your responsibility to determine any exchange rates, if applicable. All bidding increments will be USD only. Payment for any Lot that is the subject of a successful bid must also be made in USD and not in any other currency.

Limits of Liability in Online Bidding Platform 

We are not responsible for issues with internet, connection, or other technological issues. We accept no liability for any failure or delay in executing bids or any errors contained in bid placed online through the bidding platform. 

By agreeing to these Terms and Conditions, you accept full liability for all bids submitted through your account, including the liability to pay in full and on time in accordance with the Sale Conditions for any Lot that is the subject of a successful bid submitted from your account. 

We reserve the right to reject a registration to bid online, withdraw permission for you to use our auction platform, or terminate an account, for any reason at any time prior to, during or after a Sale.

Changes to These Terms and Conditions 

Any changes to these Terms and Conditions will be posted at https://www.nunneleyestates.com/bidterms. Please review the terms and conditions each time you register for a sale, as the Terms and Conditions may have changed.
